Education

The merger with Coningsbys has brought to Ormerods a national expertise in advising parents in matters relating to education law.

We regularly bring cases before Governing Bodies, Independent Appeal Committees, Special Educational Needs Tribunals and County and High Courts. Lectures are also provided for interested groups on the legal aspects of special educational needs.

In particular we offer advice and representations in the following areas:-

1. Admissions and Exclusions (Local Authority & Independent Schools)

Failing to secure a place for your child at the school of your choice can result in an appeal to the Local Authority. Similarly if your child has been excluded there is an appeal process you can use. It may be possible to proceed to the High Court if you are unsuccessful.

2. Special Educational Needs

A Government report in 1980 estimated that 20% of children have special educational needs at some time during their school career. 2% of children have severe and complex special needs requiring a Statement to be drawn up for them. We offer advice on obtaining a Statutory Assessment on the statementing procedure, appeals to the Special Educational Needs Tribunal and applications to the High Court where necessary. This includes failure by a Local Authority to make the provision outlined in the Statement.

3. Bullying

Sadly many children are bullied during their school career. We offer advice in dealing with these sensitive matters and in obtaining compensation.

4. Negligence

Currently, compensation can be claimed through the County Court for losses incurred by children and young people as a result of negligent teaching.
